1. Introduction

These Terms and Conditions (“Terms”) govern your use of the website aqxmo.co.bw (“Website”) and your purchase of goods (“Goods”) from Aqxmo Markets Pty Ltd, a company registered in Botswana under number UINBW00004258536, with registered office at Plot 163/164, Unit No.19, Gaborone International Commerce Park, Gaborone (“we”, “us”, “our”).

By accessing the Website or purchasing Goods, you agree to be bound by these Terms.
Please read them carefully before placing any Order. If you do not agree, you must not use the Website.


2. Definitions

  • Consumer – an individual buying goods for personal use, not for business.

  • Contract – the legally binding agreement between you and us regarding the supply of Goods.

  • Goods – the products listed and advertised on our Website.

  • Order – the request you submit to purchase Goods through the Website.

  • Delivery Location – the address where Goods will be delivered, as specified in your Order.

  • Durable Medium – email or printed paper that allows information to be stored and reproduced unchanged.

3. Eligibility

You may only purchase Goods from our Website if you:

We are not responsible for losses caused by your failure to safeguard login details.


7. Goods Information

  • Product descriptions on the Website are for illustration only; minor variations may occur.

  • All Goods are subject to availability.

  • If Goods are custom-made, you must ensure all specifications you provide are correct.

  • We may update or modify Goods to comply with laws or safety standards.


8. Pricing and Payment

  • Prices are displayed in Botswana Pula (BWP) and include VAT (where applicable).

  • Payment methods include credit/debit cards or other methods displayed at checkout.

  • We may refuse an Order if fraudulent activity is suspected.

  • Full payment must be received before Goods are dispatched.


9. Order Process

  1. You place an Order through the Website checkout system.

  2. We may reject an Order for any reason (e.g., stock, technical error).

  3. A Contract is formed only when we send you an Order Confirmation via email.

  4. Review your Order Confirmation and contact us immediately if incorrect.


10. Delivery

  • We aim to deliver Goods within the timeframe displayed at checkout or within 30 days.

  • Delivery delays may occur for reasons outside our control, but we will inform you.

  • If we fail to deliver within the agreed time and time is essential, you may cancel the Contract.

  • Delivery costs are displayed at checkout.

  • Goods become your responsibility upon delivery.

  • We usually deliver within Botswana; international delivery may include customs duties (paid by you).

  • If you fail to accept delivery, we may charge storage and redelivery fees.


11. Risk and Ownership

  • Risk transfers to you upon delivery.

  • Ownership transfers only after full payment.

  • If you fail to pay, we may reclaim the Goods.


12. Returns, Withdrawal & Cancellations

12.1. Withdrawal Before Contract

You may withdraw your Order before receiving the Order Confirmation.

12.2. 14-Day Return Right (Consumer)

You may cancel your Contract within 14 days of receiving the Goods.

You must:

  • Return the Goods in unused, undamaged condition

  • Pay the return shipping cost

We will refund the product price, excluding delivery fees.

12.3. Exceptions (Cannot Be Returned)

No cancellation for:

  • Custom-made or personalized Goods

  • Perishable goods

  • Sealed hygiene goods once opened

  • Sealed software, audio, or video once unsealed

  • Goods mixed with other goods irreversibly

12.4. Refund Timeline

Refunds are processed within:

  • 14 days after we receive returned Goods, or

  • 14 days after you provide proof of return (whichever is earlier)

Refunds use the original payment method.


13. Defective Goods

You are entitled to:

  • Repair

  • Replacement

  • Refund (if repair/replacement not possible)

Goods must:

  • Be of satisfactory quality

  • Match their description

  • Be fit for purpose

Manufacturer warranties apply where provided.


14. Guarantees & After-Sales Support

  • We pass on any manufacturer guarantee provided with the Goods.

  • We offer after-sales support for 1 year, following the manufacturer’s terms.


15. Limitation of Liability

We do not exclude liability for:

  • Fraud

  • Death or personal injury caused by negligence

  • Anything that cannot be excluded under Botswana law

Other than this, we are not responsible for:

  • Business losses

  • Loss of profit

  • Unforeseeable losses

We supply Goods for personal (Consumer) use only.


16. Circumstances Beyond Our Control

We are not liable for delays or failures caused by events beyond our reasonable control, such as:

  • Natural disasters

  • Strikes

  • War

  • IT system failures

  • Transport disruptions

Obligations pause during such events.


17. Intellectual Property

All Website content, including:

  • Text

  • Images

  • Logos

  • Designs

  • Product data

belongs to Aqxmo Markets Pty Ltd.
You may not reproduce, distribute, or modify it without permission.


18. Privacy

Your privacy is important to us.
Our Privacy Policy, which explains how we collect and process your personal data, forms part of these Terms.


19. Dispute Resolution

  • These Terms are governed by the laws of Botswana.

  • Disputes may be submitted to the courts of Gaborone.

  • We aim to resolve complaints within 5 working days.
